Fla. R. Civ. P. 1.540(b)(1) provides that a court may grant relief from a final judgment upon a showing of excusable neglect and a demonstration that a meritorious defense could have been asserted. Motions for relief from judgment should be liberally granted once a proper showing is made. However, it is in the trial court's discretion as to whether to grant such relief. A trial court abuses that discretion by denying such relief when proper grounds are demonstrated.
