OVERVIEW: Before dissolution of marriage proceedings were instituted, appellee wife consulted with third-party attorney. When the petition for dissolution was filed several days later, appellee was represented by a different law firm. The circuit court awarded third-party attorney fees, and appellant husband took an interlocutory appeal. The court reversed the award. Applying a strict construction to Fla. Stat. ch. 61.16, which provided for attorney's fees in divorce proceedings, the court ruled that third-party attorney was not entitled to fees because the services he provided were merely peripheral to the actual dissolution proceeding. Specifically, the court observed that the only services actually connected to the later proceedings were the examination of the antenuptial agreement and the legal research relating to the agreement's validity and that these activities were not substantially related to the dissolution proceeding, which was handled by another law firm.
